Guaranza may be used only for lawful Transactions involving genuine goods, services and digital items. This policy lists the items and activities that may not be the subject of an escrow Transaction. It forms part of our Terms of Service and applies in addition to the laws of the countries of both the Buyer and the Seller.
1. General principle
You may not create, accept, pay for or deliver a Transaction involving any item or activity that is illegal in the country of the Buyer, the country of the Seller or England and Wales, or that is listed below.
The list is not exhaustive. We may refuse any Transaction that we consider unlawful, high-risk or incompatible with our Services, even if it is not specifically listed.
2. Prohibited items and activities
The following are prohibited:
- illegal goods or services of any kind, and any goods or services that are illegal to buy, sell, possess or transfer in the country of either party;
- narcotics, controlled substances, new psychoactive substances, drug precursors and drug paraphernalia;
- prescription-only medicines, and pharmaceuticals or supplements sold with unauthorised health claims;
- weapons, firearms, firearm parts, ammunition, explosives and fireworks, items designed to injure, and plans or 3D-printing files for weapons;
- counterfeit or replica goods, unauthorised copies, and any goods, software, media or content that infringe copyright, trademarks or other intellectual property rights;
- stolen goods, goods obtained by fraud, and goods whose lawful origin cannot be established;
- any sexual content involving minors, non-consensual intimate content, and sexual services or prostitution;
- gambling, betting, lotteries, raffles and other games of chance, including the sale of gambling accounts, credits or winnings;
- securities, shares, bonds, derivatives, investment products or schemes, loans and other financial instruments;
- currency exchange, money transmission and remittance services, and any Transaction whose purpose is to transfer money rather than to buy genuine goods or services;
- gift cards, prepaid cards, vouchers, stored-value products, cryptocurrencies and other crypto-assets as the item sold, and other cash equivalents;
- user accounts, profiles, credentials, licence keys or subscriptions whose sale or transfer violates the terms of the platform or provider concerned;
- personal data, databases, contact or email lists, and leaked or scraped data;
- hacking tools, malware, exploits, botnets, phishing kits, carding tools, stolen or compromised data, and services to gain unauthorised access to systems or accounts;

- protected animals and plants, products derived from endangered species (such as ivory), and animals whose trade is restricted by law;
- human remains, body parts, organs, tissue, blood and other bodily fluids;
- hazardous materials, including toxic, flammable, radioactive or corrosive substances and dangerous chemicals;
- goods, services or technology subject to sanctions or export controls, and any Transaction involving sanctioned persons, entities or jurisdictions;
- pyramid schemes, Ponzi schemes, multi-level marketing schemes, “get rich quick” offers and similar schemes;
- anything that promotes, supports or is linked to terrorism, violent extremism, violence, or hatred or discrimination against people based on protected characteristics;
- fictitious Transactions in which no genuine goods, services or digital items are exchanged, or Transactions designed to disguise the true nature or purpose of a payment;
- creating, operating or using more than one Account (multi-accounting), or using another person's Account, including to split transaction volume or to avoid the verification threshold.
3. Items that require additional review
Some lawful items carry an increased risk of fraud or legal complications. Before accepting Transactions involving, for example, vehicles, jewellery, watches, precious metals, domain names, websites, or digital assets and licences, we may request additional information or documents and apply enhanced due diligence under our AML & KYC Policy.
4. Your responsibility
Buyers and Sellers are responsible for ensuring that the item and the Transaction comply with all laws that apply to them, including import, export, licensing, consumer protection and tax laws. The fact that we accept a Transaction does not mean that we have reviewed or approved the item.
5. Consequences of a breach
If we believe that a Transaction or Account breaches this policy, we may, without prior notice and where permitted by law:
- refuse, suspend or cancel the Transaction;
- freeze funds held in escrow;
- report the matter to the competent Financial Intelligence Unit, law enforcement or other authorities;
- return funds to their source, or hold them as required by law or by a competent authority;
- suspend or permanently close the Accounts involved;
- claim compensation for the losses and costs we incur.
To the extent permitted by law, Escrow Fees for such Transactions are not refunded.
6. Reporting a breach
If you see a Transaction or a user that you believe breaches this policy, please report it to compliance@guaranza.com.
